Agreement to Terms
TrakMiles Pro, also known as TrakMiles (“TrakMiles Pro,” “TrakMiles,” “we,” “our,” or “us”), provides the TrakMiles Pro mobile application (“the App”). By downloading, installing or using the App, you agree to these Terms of Service (“Terms”). If you do not agree, do not use the App.
Description of Service
The App helps self-employed people and small businesses record and report their business activity. It includes GPS mileage tracking, time tracking, revenue and expense records, receipt capture, profit and loss statements, Schedule C category mapping, reports and exports, an in-app Assistant that answers questions about your own records, Company Mode for sharing a set of books with others, and optional backup to your own Google Drive.
Your Data Ownership
You own your data. All trips, business records, receipts and reports you create in the App belong to you. We claim no ownership rights over your content.
You keep full control of your data and may export, change or delete it at any time using the App’s features.
Privacy
How the App handles your information is explained in our Privacy Policy, which forms part of these Terms. In short: your records are stored on your device and in your own Google Drive, not on our servers.
Your Responsibilities
- Backups: The App provides manual and automatic backup to your Google Drive and keeps your ten most recent backups. You remain responsible for making sure backups are enabled and working. We strongly recommend turning on automatic backup.
- Accuracy: You are responsible for the accuracy of what you record — trip purposes, categories, amounts, payors and any other information you enter or approve.
- Tax and legal use: You are responsible for making sure your records meet the requirements of the IRS or any other tax authority. The App provides tools to help, but we do not guarantee compliance with any regulation.
- Device and account security: You are responsible for the security of your device and of the Google account you use with the App.
Not Tax, Legal or Financial Advice
The App organises your records and performs calculations — mileage deductions, profit and loss, Schedule C categories, tax estimates and similar figures. These are provided for information and record-keeping only. They are not tax, legal or financial advice, and they are not a substitute for a qualified tax professional. Review any figures before relying on them for a tax return, reimbursement claim or business decision.
TrakMiles Pro Assistant
The Assistant answers questions using the records stored in the App. Its answers are only as complete and accurate as the underlying records, and automatically generated answers can be wrong or incomplete. Check any answer that matters before acting on it. The Assistant does not provide tax, legal or financial advice.
Company Mode
If you create or join a company in Company Mode, the records you enter for that company are shared with its other members, and theirs with you. You are responsible for what you choose to share and for deciding who may join a company you manage. Each member is responsible for the accuracy of their own entries. Sync depends on each member’s Google Drive and connectivity, so shared records may take time to appear on other devices.
Subscription & Payments
- The App offers a free trial, followed by subscription-based access.
- Subscriptions are billed through Google Play and are subject to Google Play’s terms.
- You can cancel at any time through Google Play. After cancelling, you keep access until the end of your current billing period.
- Refunds are handled under Google Play’s refund policies.
- Your records are yours whether or not your subscription is active. Backups in your Google Drive are never deleted by us, and you can always export your records to CSV, even without an active subscription.
Acceptable Use
You agree not to:
- Use the App for any unlawful purpose
- Reverse engineer, decompile or disassemble the App
- Interfere with or disrupt the App’s operation
- Create fraudulent or misleading mileage, revenue or expense records
- Share your account credentials with others
GPS & Location Services
- The App needs location permission to record trips. In Auto mode it runs in the background to detect when a drive starts and ends.
- GPS accuracy varies with device hardware, surroundings and other factors.
- We do not guarantee the absolute accuracy of mileage calculations.
- Review your trips for accuracy, especially for tax or reimbursement purposes.
Third-Party Services
The App relies on services provided by Google, including Google Play services and Google Play Billing, Google Sign-In, the Google Drive API, Google Maps, Google Firebase, and Android speech recognition for voice questions. Your use of those services is governed by Google’s own terms and policies.
Disclaimers
THE APP IS PROVIDED “AS IS” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT:
- The App will be uninterrupted or error-free
- Mileage, financial or tax calculations will be 100% accurate
- Assistant answers will be complete or correct
- The App will meet any specific tax authority’s requirements
- Your data will never be lost — which is why backups matter
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE ARE NOT LIABLE FOR:
- Any indirect, incidental, special or consequential damages
- Loss of data, revenue or profits
- Tax penalties, interest or audit outcomes related to records kept in the App
- Any amount exceeding what you paid for the App in the preceding 12 months
Indemnification
You agree to indemnify and hold harmless TrakMiles Pro and its developers from any claims, damages or expenses arising from your use of the App or your violation of these Terms.
Changes to These Terms
We may update these Terms from time to time. Continuing to use the App after a change means you accept the updated Terms. We will tell you about significant changes through the App or by email.
Termination
We may suspend or end your access to the App if you violate these Terms. You may stop using the App at any time by uninstalling it and cancelling any active subscription.
Governing Law
These Terms are governed by the laws of the State of Utah, without regard to its conflict-of-law rules. Any disputes will be resolved in the state or federal courts located in Utah.
